Study Commission on Italy-Morocco Family Legal Cooperation

AGAMI's permanent laboratory for comparative family law and international judicial cooperation

The origins

From the 2017 Bassano del Grappa Conference

The idea of promoting a study aimed at future cooperation — up to the hypothesis of a bilateral Italy-Morocco Convention on family law — arose within the international conference “Women's Rights – For Intercultural Legal Comparison”, organized by AGAMI in Bassano del Grappa, at Villa Ca' Rezzonico, on March 11, 2017. On that occasion an Italian-Moroccan study commission was set up, devoted to the comparative analysis of the legal systems of the two countries and to the search for cooperation instruments capable of ensuring better protection of transnational families and minors.

From that path, begun in 2017 and developed over the years, comes AGAMI's most ambitious project: a Study Commission that promotes research and exchange activities aimed at drawing up technical proposals to strengthen legal cooperation between Italy and Morocco.

It is the project that best expresses AGAMI's vocation: not only studying the law, but contributing to its evolution.

The project

A permanent laboratory for comparative family law

The Commission is AGAMI's permanent laboratory for comparative family law and international judicial cooperation, with particular attention to the Italy-Morocco axis: it is the theme that most distinguishes AGAMI from other centers.

The Commission will also analyze the conventional instruments and family cooperation agreements existing between European States and non-European countries, in order to identify models useful for strengthening cooperation between Italy and Morocco.

The subjects at the center of the work

  • Family law and protection of minors
  • Parental responsibility
  • Mixed marriages
  • Transnational successions
  • Recognition of foreign decisions
  • International child abduction
  • International family mediation
The Commission operates as a scientific study body and does not exercise negotiating functions, which remain the exclusive competence of States.

Aims and method

Four lines of work

  • Analyzing the critical issues in family relations between the two legal systems.
  • Comparing the cooperation models already adopted in other European countries.
  • Drawing up technical proposals and recommendations addressed to the competent institutions.
  • Involving academics, judges and professionals from both shores.

The scientific basis

The Observatory on International Family Conventions and Judicial Cooperation maps and analyzes the conventional instruments governing transnational family relations and constitutes the scientific basis of the Commission's work.
