Privacy Notice

Privacy notice on the processing of personal data provided pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (GDPR)

This notice is drawn up pursuant to Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree No. 196/2003, as amended by Legislative Decree No. 101/2018, and concerns the processing of personal data carried out by AGAMI APS in the context of the Association's activities and of the RCMI platform — Network of Moroccan Competences in Italy.

1. Data Controller

The Data Controller is AGAMI APS (registered office: Via Sandrigo n. 29, 36061 Bassano del Grappa (VI); tax code: 91036640240), registered in the National Single Register of the Third Sector (RUNTS) — RUNTS – Repertorio n. 149809. Contacts: agamiassociazione@gmail.com.

The entity is not required to appoint a Data Protection Officer (DPO); should one be designated, the relevant contact details will be indicated at the end of this notice.

2. Categories of data processed

  • personal and identification data (first name, surname, date and place of birth);
  • contact details (address, e-mail, telephone number);
  • data relating to profession, educational qualifications, credentials, competences and curriculum vitae;
  • photographic image, where provided;
  • special categories of data (Art. 9 GDPR): within the RCMI, membership and the data provided may reveal the data subject's ethnic or national origin. Such data are processed exclusively where explicit consent has been given (see the section on the consents required by the forms).

3. Purposes of processing and legal bases

  • a) Management of membership and of the membership relationship. Performance of the membership relationship and fulfillment of the related obligations — Art. 6(1)(b) GDPR — as well as the entity's legitimate interest in managing its membership base — Art. 6(1)(f).
  • b) Inclusion in the RCMI and publication of the profile. The data subject's consent — Art. 6(1)(a) — and, for the special categories referred to in point 2, explicit consent pursuant to Art. 9(2)(a) GDPR. Publication of the profile constitutes dissemination of personal data and therefore requires specific consent, distinct from that relating to membership alone.
  • c) Sending of communications and newsletters. The data subject's consent — Art. 6(1)(a) GDPR.
  • d) Publication of photographs and images. The data subject's consent — Art. 6(1)(a) GDPR — in compliance with the right to one's image under Article 10 of the Italian Civil Code and Articles 96-97 of Law No. 633 of 22 April 1941.
  • e) Legal obligations. Accounting and tax obligations and obligations connected with the rules governing Third Sector Entities (Legislative Decree No. 117/2017) — Art. 6(1)(c) GDPR.

4. Nature of data provision

The provision of data for the purposes referred to in point a) is necessary for membership: refusal makes it impossible to establish the membership relationship. The provision of data for the purposes referred to in points b), c) and d) is optional: any refusal, or failure to give the relevant consent, does not affect membership, but prevents the provision of the corresponding service only (for example, publication of the profile in the RCMI).

5. Processing methods

Data are processed using paper-based and electronic means, in accordance with the principles of lawfulness, fairness, minimization and security, and are accessible only to the entity's authorized personnel. Appropriate technical and organizational measures are adopted to prevent loss, unauthorized access and unlawful use.

6. Recipients and dissemination

Data may be communicated to parties operating on behalf of the Controller as data processors (for example, IT and hosting service providers) and to authorities and supervisory bodies in the cases provided for by law. Only data for which specific consent to the publication of the profile has been given are disseminated through AGAMI's website and official channels.

7. Transfer of data to third countries

Should data need to be transferred outside the European Economic Area by reason of cooperation with the Kingdom of Morocco or with other countries, the transfer will take place in compliance with Articles 44 et seq. of the GDPR, subject to appropriate safeguards (for example, standard contractual clauses) or on the basis of one of the conditions set out in Article 49.

8. Retention period

Data are retained for the duration of the membership relationship and, thereafter, for the time necessary to fulfill legal obligations. Data published in the RCMI are removed following withdrawal of consent or termination of membership. Data processed on the basis of consent alone are retained until such consent is withdrawn.

9. Rights of the data subject

Data subjects may at any time exercise the rights provided for in Articles 15 to 22 of the GDPR: access, rectification, erasure, restriction of processing, portability and objection. They also have the right to withdraw consent at any time, without affecting the lawfulness of processing carried out before such withdrawal. Requests should be addressed to the Controller at the contact details indicated in point 1.

Data subjects who consider that their rights have been infringed may lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali) (Art. 77 GDPR) or bring an action before the judicial authorities (Art. 79).

10. Minors

Membership is reserved for adults. Where the entity provides for specific activities aimed at minors, the related processing will be carried out with the consent of the holder of parental responsibility, pursuant to Article 8 of the GDPR.

Online forms

The consents required by the forms

The membership and RCMI forms provide for separate, freely revocable consents, each relating to a specific purpose. Consent No. 1 is necessary for membership and Consent No. 2 is necessary for inclusion in the RCMI (refusal does not affect membership of AGAMI); Consents Nos. 3, 4 and 5 are optional.

Special categories of data (Art. 9 GDPR)

Explicit consent to the processing of data which, within the RCMI, may reveal ethnic or national origin, for the purposes of inclusion in the Network. Refusal does not affect membership, but makes inclusion in the RCMI impossible.

Publication of the profile (professional data and competences) on AGAMI's website and official channels.

Photographs and images

Publication of photographs and images in AGAMI's materials and channels, pursuant to Article 10 of the Italian Civil Code and Articles 96-97 of Law No. 633/1941.

Newsletter and communications

Receipt of AGAMI's newsletter and informational communications.

Newsletter — double opt-in. The newsletter subscription becomes active only after confirmation via the link received by e-mail; without confirmation no communication is sent and the address is not used. Every communication contains an immediate unsubscribe link.
“Find an expert” form. The data submitted with the matching request (contact details and description of the need) are processed solely to handle the request and facilitate contact with the network's professionals; members' contact details are never disclosed directly to the requester, nor vice versa, without the consent of the persons concerned.

RCMI platform

Rules of the RCMI platform

Purpose

The RCMI is a space promoted by AGAMI APS to enhance and connect professional and scientific competences of Moroccan origin in Italy.

Requirements

Membership is reserved for adults who provide truthful and up-to-date data.

Publishable content

Only data for which specific consent has been given are published. AGAMI reserves the right not to publish, or to remove, content that is inappropriate, irrelevant or detrimental to the rights of others.

Updating and removal

Members may at any time request the modification or removal of their profile; withdrawal of consent entails the cessation of publication.

Liability

The information disseminated is of a general nature and does not constitute individual professional advice. Each member is responsible for the truthfulness of the data provided.

Amendments and jurisdiction

AGAMI may update these rules by providing notice on the website. Any dispute shall fall within the jurisdiction of the courts of the place where the entity has its registered office, unless otherwise provided by mandatory rules.
